Australian Worldwide Exploration Limited (AWE) has applied for an extension to the Tui pipeline protection area (Submarine Cables and Pipelines Protection (Tui Area Development) Order 2007) because a proposed new well is outside the current protection area. The area in question is approximately 3km². AWE’s Tui oil field is off the coast of Taranaki.

A protection order prevents damage to undersea pipelines and cables from activities such as fishing and anchoring.

A protection order may only be amended by the Governor-General by Order in Council on the recommendation of the Minister of Transport. The Minister under section 12(2) of the Submarine Cables and Pipelines Protection Act 1996 must not recommend an amendment unless:

  1. the Minister has first consulted with such persons or organisations representing the such persons as the Minister considers would be affected by the Order
  2. those persons or organisations have a reasonable opportunity to make submissions to the Minister
  3. the Minister has regard to those submissions

The submission period has closed and the Ministry intends to brief the Minister of Transport in the first quarter of 2014.
